A Jefferson County jury returned a guilty verdict in the trial of Ezekiel Mark Garcia, DOB: 10-27-93. Mr. Garcia killed his girlfriend, 22-year-old Destini Martinez. The jury found Mr. Garcia guilty of First Degree Murder After Deliberation and Tampering with Evidence.
On March 7, 2018 Westminster police were called to 5540 W. 79th regarding a gunshot victim. Mr. Garcia had called 911 but gave false information about the shooting and a false name to the operator. Police arrived at the home shared by Mr. Garcia and Ms. Martinez to find her lying on the bed with a gunshot wound to her head. She was pronounced dead at the scene. Mr. Garcia fled the scene with the couple’s five-year-old son prior to police arriving.
Using cell phone technology, police were able to trace Mr. Garcia as he traveled westbound on I-70 to the Evergreen area. They located the child at Mr. Garcia’s mother’s home. Shortly after Westminster police located the child, they got a call from the Thornton Police Department saying Garcia had turned himself in.
March 7, 2018 was Destini’s 22nd birthday. She, Garcia, her family and friends had been out to dinner earlier that evening to celebrate. Witnesses testified that the couple had been arguing earlier that day.
At trial, Mr. Garcia testified that he traveled to Evergreen to get rid of the murder weapon. Mr. Garcia said that he threw the gun off the side of the highway when he was on I-70.
Garcia and Ms. Martinez had been in an on-again-off-again relationship since junior high school.
There was a history of domestic violence. He had threatened to kill her on multiple occasions, and he stabbed her in the leg with a knife five weeks prior to the murder.
Sentencing is set for March 19 at 1:30. He faces life in prison without the possibility of parole.
