A Jefferson County jury deliberated for three hours, rejecting an insanity defense and returning a guilty verdict in the murder of 35-year-old Molly Nickal. Gary Lee Nickal, DOB/7-22-77, Molly’s husband, shot her twice, once in the head, with a pump-action shotgun in 2016. The verdict was returned on May 10, 2018.On April 28, 2016 Westminster Police were called to 5848 W. 9th Place where they found Molly Nickal deceased. Gary Nickal and their three small children were at the house when police arrived.The evidence at trial showed that Gary and Molly Nickal had a difficult relationship. She had left him several times because he was emotionally abusive and volatile. They had been separated for several months until their third child was born in February, 2016. Molly then went back to him, one more time, for financial reasons and to try to keep the family together.Two days before she was murdered, Molly contacted an attorney to begin the process of having Gary served with divorce papers and getting sole custody of the children. She was also getting her affairs in order while making plans to leave and take the children with her.At 6:00 a.m., while Molly was in the bathroom, Gary Nickal ambushed her and shot her to death.“This is such a tragedy. Molly was drawn back to him again and again with hope that it would be different, that he would change,” says DA Pete Weir, “Mr. Nickal deserves to spend the rest of his life in prison.”Following the return of the jury’s verdict, the parties requested sentencing the next morning. He was sentenced to life in prison by Chief Judge Philip McNulty on May 11, 2018.
