(Golden, CO – May 22, 2020) District Attorney Pete Weir announced today that charges have been filed in the vehicular homicide death of 24-year-old James Michael Graham on May 15, 2020 in Lakewood. Four other people were also seriously injured in the collision. Terry McFadden, Jr., DOB: 10-8-95, has been charged with two counts of Vehicular Homicide, under the theory of DUI (F3) and under the theory of Reckless (F4); four counts of First Degree Assault – Extreme Indifference (F3); three counts of Vehicular Assault - DUI (F4); three counts of Vehicular Assault – Reckless (F5); DUI (M); and Careless Driving (T1). McFadden appeared in court on May 22nd to be advised of the charges.
Shortly before midnight on May 15, 2020, Lakewood police were called to a traffic collision on eastbound 6th Avenue, just east of Union Blvd. According to the arrest affidavit, they found two vehicles which appeared to have been involved in a front to rear end collision. One of the vehicles, a Lincoln sedan had been hit in the rear. It was off the road when police arrived and there were three people trapped inside. There had been five people inside the Lincoln at the time of the collision. West Metro Fire extricated the three people who had been trapped and transported the critical patients. The second vehicle, a Kia, had been driven by Mr. McFadden. He was arrested and booked into the Jefferson County jail.
James Graham was a passenger in the Lincoln. He died from his injuries on May 20, 2020.
Two other men and two women were also inside the Lincoln. The male driver and the other man, and one woman suffered serious bodily injury. The fourth person, a woman, suffered bodily injury.
Terry McFadden posted $8,000 bond on the day he was arrested, May 16, 2020. He is due back in court on June 18 at 9:00 for preliminary hearing.
