Retail Food Establishment Regulations

Regulation Update Effective March 16, 2024 

On January 17, 2024 Colorado adopted the FDA 2022 Model Food Code by reference as the revised Colorado Retail Food Establishment Rules and Regulations.

 The major changes for retail food establishments are:

  • Beginning March 1st, 2025 the person in charge must be a Certified Food Protection Manager at most food establishments. 
  • Note that this requirement is the only one which has a delayed effective date. All other requirements are effective March 16, 2024.
  • Written procedures for cleaning up vomiting and diarrheal events are required.
  • Retail food establishments shall notify customers of major food allergens used as ingredients.
  • Raw animal food shall be stored separately from unwashed fruits and vegetables.
  • Commercially packaged food that has cooking instructions must be prepared according to those instructions unless the manufacturer states it can be consumed without further cooking.

Retail Food Establishment Regulations: Effective 2019

Colorado has incorporated the 2013 FDA Food Code by reference as the revised Colorado Retail Food Establishment Rules and Regulations, which is effective as of January 1, 2019.

Some of the major changes for retail food establishments are:

  • Required certified food protection managers
  • Proper date marking of ready to eat foods that must be maintained cold for safety
  • Procedures in place for the proper cleanup of vomiting and diarrheal events
  • Handwashing signs at all handwashing sinks used by employees
