Foreclosure, the forced sale of a piece of property to repay a debt, is conducted by the Office of the Jefferson County Public Trustee on Deeds of Trust containing a power of sale. Colorado Revised Statutes specify the procedure for conducting the foreclosure, which must be followed exactly.
The Deed of Trust is an agreement between three parties:
- The Grantor (owner)
- The Public Trustee (who has the power of sale)
- The Beneficiary (lender)

Note: Due to significant changes in the law, the way in which a foreclosure is processed depends on the date the Notice of Election and Demand (NED) was recorded with the Jefferson County Clerk and Recorder.
